Furthermore, in compliance with government policy and in order to protect society and safeguard
               public health-particularly that of children, youth, students, and the general public-the Customs Department
               shall not enter into any compromise settlement to suspend prosecution at the customs stage. Instead,
               the responsible agencies shall forward cases to inquiry officers for prosecution until final adjudication.

               This applies to cases involving the seizure or arrest of baraku, electronic baraku, electronic cigarettes,
               or any substances, extracts, or other items used as a source of smoke or vapor for smoking in the form
               of baraku, electronic baraku, or electronic cigarettes, in the following circumstances:
                      1. Where the quantity of such goods, whether of one type or in combination, exceeds ten items,

               or
                      2. Where such goods are possessed in a manner indicating commercial intent or for sale to the
               general public, regardless of quantity.
