1. Cooperation under FTA
The Customs Department, with Customs Tariff Bureau as the head of Thai Delegation in the
Negotiation on Rules of Origin in FTA, has been assigned the responsibilities to join Rules of Origin
negotiations for Customs privileges between FTA partner nations as follows:
Regional Comprehensive Economic Partnership: RCEP Apart from being the head of Thai
delegation in the negotiation on rules of origin, the Customs Department has also been assigned
the chair role in the working group on rules of origin and in the ASEAN working group on the same
subject matter. RCEP is also one of the strategies in AEC Blueprint, made between ASEAN and
6 major trade partner nations: China, Japan, South Korea, India, Australia, and New Zealand, to
maintain the centrality of ASEAN. At the present, the negotiation of rules of origin has reached an
agreement on 12 articles and a conclusion on PSRs at 52% of Harmonized System based Customs
Tariff
A EA G A : A GA At the present, ASEAN has speeding up the
establishment of AS A -Wide Self Certifcation system and the adjustment of S s following
Harmonized System 2017 (HS2017) to facilitate requests for Customs privileges in terms of
timeliness and accuracy. Additionally, on 1 January 2018, Thailand and 4 other ASEAN member
states, Singapore, Malaysia, Viet am and Indonesia, have adopted Certifcate of Origin Form D
(e-Form D), which the country of origin would submit through ASEAN Single Window (ASW) to the
Customs of the importing member countries directly. The development of such certifcate would
prevent false subrogation of rights by fabrication of certifcates to seek preferential Customs tariff
rates in the importing countries. The system would also save cost in issuing hard copy certifcates
and facilitate and shorten import procedures.
A EA -C F A The Customs Department has participating in the meeting of the working
group on rules of origin under the committee on the implementation of ASEAN - China FTA.
The meeting has concluded the list of PSRs in the Protocol to Amend the Framework Agreement
on Comprehensive Economic Co-operation and Certain Agreements. The new PSRs will come into
force along with the new rules of origin under the Protocol to Amend the Framework Agreement
on Comprehensive Economic Co-operation and Certain Agreements thereunder between ASEAN
and the People’s Republic of China when all 11 member countries (ASEAN and China) have completed
their internal process.
